These Terms of Service (“Terms”) govern your use of the AsBuilt mobile application, website, and related services (“Services”) provided by ASBUILT LLC (“AsBuilt,” “we,” “us,” or “our”).

By creating an account or using the Services, you agree to these Terms.

1. Overview

AsBuilt provides digital tools for builders and homeowners, including construction photo documentation, manuals, maintenance tracking, and project handoff features.

There are two primary user roles:

• Builders: Create and manage projects, upload content, and invite homeowners.
• Homeowners: View project information shared by their builder.

2. Eligibility

You must be at least 18 years old to create an account.

3. Account Responsibilities

You agree to:

• Provide accurate account information
• Maintain confidentiality of your account credentials
• Immediately notify us of unauthorized access
• Use the Services in compliance with all applicable laws

4. Builder Responsibilities (IMPORTANT)

Builders acknowledge and agree that:

1. They are solely responsible for all content they upload, including photos, documents, manuals, and product information.
2. They must have the legal rights and permissions to upload any content added to AsBuilt (including construction photos, plans, manuals, and documents).
3. AsBuilt does not review, verify, or endorse builder-uploaded content.
4. Builders must ensure no confidential, copyrighted, or sensitive personal information is uploaded without proper authorization.
5. Builders are solely responsible for ensuring uploaded content complies with local, state, and federal laws.
6. AsBuilt may remove or restrict access to content if it violates these Terms or applicable law.

This clause protects builders, homeowners, and AsBuilt from legal disputes related to content ownership and privacy.

5. Homeowner Access

Homeowners can:

• View project data shared by their builder
• Access construction photos, product information, manuals, and maintenance tasks
• Mark maintenance tasks as complete

Homeowners cannot:

• Modify builder-uploaded content
• Access other homeowners’ projects
• Add unauthorized users

6. Ownership of Content

• Builders retain full ownership of the content they upload.
• AsBuilt does not claim ownership of builder-uploaded photos, manuals, or project data.
• By uploading content, builders grant AsBuilt a limited, revocable license to store, display, and deliver the content to invited project members.

7. Acceptable Use

You agree not to:

• Upload malware, harmful code, or disruptive content
• Attempt unauthorized access to accounts or systems
• Interfere with the Services or infrastructure
• Use the platform for illegal purposes
• Harass or harm other users
• Upload content you don’t have rights to

Violations may result in suspension or termination of access.

8. Termination

We reserve the right to suspend or terminate accounts for violations of these Terms or misuse of the Services.

Users may delete their accounts at any time.

9. Disclaimers

The Services are provided “as is” without warranties of any kind.

AsBuilt makes no guarantees regarding:

• Availability
• Accuracy of builder-uploaded content
• Compatibility with all devices

Builders, not AsBuilt, are responsible for the accuracy and completeness of project information.

10. Limitation of Liability

To the fullest extent permitted by law:

• AsBuilt is not liable for any damages arising from the use or inability to use the Services.
• Builders are solely responsible for the content they upload and any consequences thereof.

In no event will AsBuilt be liable for indirect, incidental, special, or consequential damages.

11. Governing Law

These Terms are governed by the laws of the State of Washington.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
